Terms & Conditions

1. Agreement
These Terms & Conditions (“Terms”) govern access to and use of PsychApp (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a clinic or organization, you confirm you have authority to bind it.
2. The Service
PsychApp provides practice-management software for mental-health professionals: scheduling and public booking, clinical documentation, psychometric assessments, a client portal, secure messaging, video sessions, billing tools, and optional AI features. PsychApp is software only — it is not a healthcare provider and does not provide medical, psychological, or legal advice.
3. Accounts and eligibility
- Practitioner accounts are intended for licensed or registered health professionals (or trainees under appropriate supervision) practising in Canada.
- You are responsible for the accuracy of your account information, for safeguarding your credentials, and for all activity under your account.
- You must be of the age of majority in your province.
4. Professional responsibility
You retain sole responsibility for all clinical decisions, documentation, diagnoses, treatment, and compliance with the standards of your regulatory college. Content produced by the Service — including assessment scoring, interpretations, templates, and AI outputs — is decision support and never replaces professional judgment. The Service must not be relied upon in emergencies.
5. Client data and privacy roles
As between you and PsychApp, you are the health information custodian of your clients' records; PsychApp processes them as your service provider under your instructions, as described in the Privacy Policy. You represent that you have the authority and consents required to collect and store the client information you enter, including consent for communications sent through the Service (such as email reminders) and for session transcription where used.
6. AI features
- The Clinical AI Assistant and Session Scribe are optional add-on features governed additionally by the in-product terms accepted at subscription.
- AI outputs may be inaccurate or incomplete; citations must be verified before reliance. You must review every AI-drafted note before saving or signing it.
- You agree not to include identifying client information in assistant queries and to obtain client consent before using the Scribe.
7. Acceptable use
- No unlawful use, and no use outside a professional context that the Service is designed for.
- No attempts to breach security, probe other practices' data, or disrupt the Service.
- No reselling, scraping, or reverse-engineering the Service.
- No uploading of malicious code or content you lack rights to.
8. Fees, trials, and cancellation
- Paid plans begin with a free trial (currently 14 days). After the trial, plans bill monthly in Canadian dollars through Stripe until cancelled.
- Optional add-ons (such as the Clinical AI Assistant) bill monthly in addition to the base plan.
- You may cancel at any time; access continues to the end of the paid period. Fees already paid are non-refundable except where required by law.
- Prices may change with at least 30 days' notice.
9. Your data and our IP
You own the data you and your clients enter. You grant PsychApp the limited licence needed to host, process, back up, and display it to operate the Service. PsychApp and its software, design, and content (excluding your data) remain the property of PsychApp and its licensors. You may export your data at any time.
10. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may improve, modify, or discontinue features with reasonable notice for material changes. We may suspend accounts that breach these Terms or create security risk.
11. Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, PsychApp disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. PsychApp does not warrant that assessment scoring, reminders, AI outputs, or any other feature will be error-free.
12. Limitation of liability
To the maximum extent permitted by law: (a) PsychApp is not liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of profits, data, or goodwill; and (b) PsychApp's total liability for all claims in any twelve-month period is limited to the fees you paid to PsychApp in that period. Nothing in these Terms limits liability that cannot be limited under applicable law.
13. Indemnity
You will indemnify PsychApp against third-party claims arising from your clinical services, your breach of these Terms, or your violation of law, except to the extent caused by PsychApp's own breach.
14. Termination
You may close your account at any time. We may terminate or suspend for material breach after notice where practicable. Upon closure, export your data promptly; Section 9 of the Privacy Policy governs retention thereafter.
15. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, and the courts of Ontario have exclusive jurisdiction, except where the law of your province grants you non-waivable rights.
16. Changes to these Terms
We may update these Terms; material changes will be announced by email or in-app notice at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
